Terms of Service for Designbydal – Digital Marketing Company

Welcome to Designbydal’s Terms of Service. These terms govern your use of our digital marketing services. By accessing or using our services, you agree to comply with and be bound by these terms. If you do not agree with any part of these terms, please do not use our services.

Scope of Services

Designbydal offers digital marketing services, including but not limited to, social media marketing, search engine optimization, content creation, and online advertising. The specific details of the services provided will be outlined in a separate agreement between Designbydal and the client.

Client Responsibilities

Clients are responsible for providing accurate and timely information necessary for the provision of services. This includes access to relevant accounts, materials, and cooperation in the implementation of marketing strategies.

Payment and Billing

Payment terms and billing details will be outlined in the client agreement. Designbydal reserves the right to suspend services for non-payment. Late fees may be applied to overdue invoices.

Intellectual Property

All intellectual property created or provided by Designbydal in the course of providing services, including but not limited to designs, content, and marketing materials, shall remain the property of Designbydal unless otherwise agreed upon in writing.

Confidentiality

Designbydal and the client agree to keep confidential any proprietary or sensitive information disclosed during the provision of services. This includes, but is not limited to, business strategies, financial information, and trade secrets.

Termination of Services

Either party may terminate services with written notice, subject to the terms of the client agreement. Designbydal reserves the right to terminate services immediately in the event of a material breach of these terms.

Limitation of Liability

Designbydal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the services provided. The total liability of Designbydal, whether in contract, warranty, tort (including negligence), or otherwise, shall be limited to the fees paid by the client for the specific services giving rise to the claim.

Indemnification

Clients agree to indemnify and hold Designbydal harmless from any claims, damages, losses, or liabilities arising out of the client’s use of the services, breach of these terms, or violation of any applicable laws.

Changes to Terms

Designbydal reserves the right to update or modify these terms at any time. Notice of changes will be provided to clients, and continued use of the services

Governing Law

These terms are governed by and construed in accordance with applicable laws. Any disputes arising out of or in connection with these terms shall be resolved through arbitration in accordance with applicable rules and regulations.

By using Designbydal’s services, you acknowledge that you have read, understood, and agreed to these terms.
